Release Osman Kavala on the 60th day of his detention!

Osman Kavala was taken into custody on October 18, 2017 and detained November 1, with accusations as “an attempt to abolish the constitutional order of the Republic of Turkey, an attempt to prevent or lifting the tasks of the state, being the organizer of Gezi Resistance which all terrorist organizations (FETO/PDY - PKK / KCK – DHKP/C, MLKP) actively participated and supported”. Osman Kavala is kept in isolation conditions in Silivri Prison for 60 days. Osman Kavala was clearly targeted by the media which has close tights with government before his arrest, and this demonstration continued increasingly during his custody.

Osman Kavala has participated in the establishment of the İletişim Publications in 1983 in order to provide democratization and civilianization of the country through publishing in the repressive environment after 12 September coup. In the following years, he has provided great support to the recognition of cultural diversity, cultural arts dialogue and cultural co-operation and has actively worked in Civil Society organizations. Osman Kavala has established an effective relationship between Turkey's civil society and the outside world.

As we explained in detail in the file notes announced to the public on 11 July, 14 August and 8 September 2017, a training workshop was organised in Büyükada (Prinkipo), İstanbul on 2-7 July 2017 on the basis of the decision and information of the civil society organisations under the Human Rights Joint Platform. On the fourth day (5 July 2017) the workshop had been raided by the police upon the instructions issued by the Office of Adalar (Prince Islands) Chief Public Prosecutor, and 10 rights defenders were detained. 8 of the rights defenders were detained and 2 were released on judicial control. About three months later on 4 October 2016, an indictment was issued by the Office of İstanbul Public Prosecutor involving charges of membership to illegal organisation and aiding illegal organisations. This indictment was admitted on 16 October 2017 by the Heavy Penal Court no 35 of İstanbul and 25 October 2017 was set as the date for the first hearing. The indictment prepared by the prosecutor’s office also included among the list of suspects Amnesty International’s President of Board for Turkey Branch Attorney Taner Kılıç who was detained on June 6, 2017 and is still in remand.

It has been 40 days since 10 human rights defenders, whose fundamental position is to advocate for human rights and freedoms, gender equality and human safety, were detained in the early hours on the morning of 5 July 2017 upon the warrant issued by the Office of the Chief prosecutor of Adalar-İstanbul on the fourth day of a series of meetings held as an activity of Human Rights Joint Platform in an open and transparent environment, and undertaken with the knowledge, approval and initiative of human rights organizations in order to understand the threats and risks arising from the ongoing developments, which have a direct impact on the work of the HRDs; to better equip them vis-à-vis such risks; and to protect them, their work and the rights’ subjects they are working together on the digital and virtual environment. The process continues with 8 of the said 10 in remand and 2 released on parole.

Joint Press Statement concerning the Arrest of Amnesty International Turkey Chairperson Taner Kılıç

Taner Kılıç who was detained early in the morning on 6 June 2017 was arrested on 9 June 2017 late in the night at about 23.30. Since the arrest decision is a clear violation of the right to liberty and security of the person, human rights defenders and civil society organisations declared the decision to be unlawful with deep concerns.

Taner Kılıç is a respectful human rights defender for years, especially active in the field of refugee rights and law. He is working in the field with valuable and renunciant effort. He is also the Chairperson of Amnesty International Turkey of which he was also one of the founders. His arrest relying on a common, mere allegation and being treated as if he was already convicted made human rights community indignant.

Human rights defender lawyer Taner Kılıç should be released immediately!

Lawyer Taner Kılıç who was detained by Anti-Terror Police of İzmir following the search at his house and his personal Office on 6 June 2017 should be released immediately.
Lawyer Taner Kılıç, as a well-known human rights defender who dedicated his life to defending human rights in general and refugee rights in particular, has played an indispensable role in creating awareness and advocating for the human rightss of refugees in Turkey. He is one of the founding members of Amnesty International Turkey and has been serving as the Chair of the Board of Amnesty International Turkey since 2014. He is also one the founding members of the Solidarity Association with Refugees and an active member of the Refugee Rights Committee of İzmir Bar Association and Refugee Rights Commission of the Union of Bar Associations of Turkey.

We nominate Orhan Kemal Cengiz for the Vaclav Havel Human Rights Prize 2017

We, the members of the Board of the Human Rights Agenda Association (IHGD), have decided to nominate our co-founder and former chairman, human rights lawyer Orhan Kemal Cengiz for this year's Vaclav Havel Human Rights Prize. The prize was created in 2013 by the Parliamentary Assembly of the Council of Europe (PACE) in collaboration with the Vaclav Havel Library and Charta 77 Foundation.

The basis for our nomination of Orhan Kemal Cengiz is his admirable work in the field of human rights throughout the last 20 years. Six other organisations and individuals have promptly joined forces with our organisation in endorsing the nomination of Orhan Kemal Cengiz for the prize: UN Watch, one of the leading organisations monitoring the UN's human rights work; Taner Kılıç, lawyer and chairman of Amnesty International Turkey; Gerald Knaus, chairman of the European Stability Initiative (ESI); Hüsnü Öndül, lawyer and former chairman of the Human Rights Association (IHD); Assoc. Prof. Dr. Bican Şahin, chairman of the Freedom Research Association; and Ayşe Bilgen, former vice-chairwoman of the Human Rights Research Association (IHAD).

Is The State of Emergency Inquiry Commission, Established By Emergency Decree 685, An Effective Remedy?

Following the proposal made by the Secretary General of the Council of Europe as well as the Venice Commission concerning the creation of an independent ad hoc body for the examination of individual cases of dismissals, subject to subsequent judicial review, the Government issued a Decree Law No: 685 concerning the establishment of a Inquiry Commission on 23 January 2017.

Dr.Kerem Altıparmak of Ankara University, Faculty of Political Sciences, analyzes the State of Emergency Inquiry Commission, established by Emergency Decree 685 dated 23 January 2017, in this brilliant article and argues whether it is an effective remedy or not. We sincerely wish the Commission to take into consideration the analysis pointed out in the article.

Günal Kurşun is a Human Rights Defender

Ass. Prof. Gűnal Kurşun, a well-known scholar in the field of International Criminal Law and Genocide studies teaching working at the Criminal Law Department of the Çukurova University in Adana and President of the Insan Hakları Gűndemi Derneği-Human Rights Agenda Association (IHGD-HRAA), member  of the IHOP-Human Rights Joint Platform, has been dismissed from his functions due to the New Statutory Decree n. 675, issued on October 29th.     

Since many years, Gűnal Kurşun is fighting for the respect of human rights and civil liberties, denouncing all forms of violence in an independent and impartial manner. A key figure in the human rights movement in Turkey, whose works and academic contributions range from women rights to Freedom of Expression, from minority rights to social, economic and cultural ones till his engagement within the Coalition for the International Criminal Court, his passion brought him  to choose to share his expertise in the field of human rights with new generations, in an attempt to provide his students with the relevant tools needed for the advancement of democracy in the country.

Muzaffer Şakar, executive of Democrat Judiciary Association, Judge at Diyarbakır Court House and Human Rights Defender, must be released!

Taken under custody on 11 August 2016, Muzaffer Şakar –executive of Democrat Judiciary Association and one of the judges at Diyarbakır Court House– is a human rights defender well-known to all institutions and bodies dealing with human rights issues and well-respected due to his work on human rights and specifically fair trial and problems of the judicial organs.  He served as a rapporteur of the Human Rights Institution of Turkey and, he is a human rights defender for all segments of the society.

Şakar is a jurist, who has long been raising the activities of the group that perpetrated the coup attempt within the judiciary. He is an adherent of professional ethics and principles as a jurist. His promotion as Category I judge has been delayed for four years as Şakar’s professional records were unjustly tampered with by two justice inspectors, who are still arrested due to their activities [linked to the aforementioned group]. He has waged a struggle for years against the unfair interventions of the inspectors in the personnel record. In spite of the fact that he is a successful jurist, he has been appointed to places considered as ‘exile’ and he has not been assigned active tasks. In the two books (one he wrote and the other, he contributed) he has raised the extra-legal practices and the organization, within the judicial system, of the [said] religious community since 2010.
